Any nominations for new Justices must pass through the Judiciary Committee. The Committee has rules that protect the integrity of the process and ‘the regular order.’ Our legislative bodies operate on these rules. Otherwise we would have chaos. Senator John McCain voted against the ‘skinny repeal’ of the Affordable Care Act based on the violation of ‘the regular order.’ It was not presented for a floor vote using the proper procedure.
Procedure is our friend. ‘Regular order’ is our friend.
Please allow me to share some of those Committee Rules.
The Chairman shall entertain a non-debatable motion to bring a matter before the Committee to a vote. If there is objection to bring the matter to a vote without further debate, a roll call vote of the Committee shall be taken, and debate shall be terminated if the motion to bring the matter to a vote without further debate passes with twelve votes in the affirmative, one of which must be cast by the minority.
