eBay lets users opt out of arbitration agreement IF you send them a letter via the Post Office

Giggling, but in annoyance, after reading the new eBay user agreement sent me this morning.

The agreement has a new arbitration clause that notifies the user that she may opt out of arbitration.

Why is this important? If you do not opt out of arbitration, you cannot join a class action suit against eBay for any reason.

So, in order to protect your legal rights you must write a real letter to eBay. eBay does not provide the ability to “click” anywhere to do this.

Show them you pay attention to their shenanigans! I find it unlikely that they have made a pact with the Post Office. Rather, they want to make it as time-consuming as possible to avoid their trap.

For your convenience, I have uploaded a sample letter should you choose to follow the same path as me. The text is also pasted below.
